The police report says the other car is at fault.  Why is the insurance company denying my claim?

The police report is the officer’s opinion based on the information collected at the scene of the accident.  It can be great evidence in the case but in doesn’t mean the insurance company will agree with everything in it and the police do not speak for the insurance company as far as liability is concerned.

I seen many insurance companies deny claims where the police report is in you favor.  A couple of the big reasons for denial that I see are that you are also partially at fault and that the police report is wrong because you caused the accident.

When someone is injured in an accident it is important to remember that the insurance company is not on your side.  They will do everything possible to limit their clients responsibility in the accident.

If you are involved in a car accident in Texas, there are several things you should do.  The first step is to call the police so that the accident is documented through an accident report.

The second step is to make sure any injuries are treated.  If you are severely injured at the scene and need an ambulance, call 911.

If the injury is not severe, you may be able to wait until after the police officer completes the accident report before you go to the emergency room.  I find that some people no matter how badly they are injured do not do this.

They think they will feel better in a couple of days so they take no steps to make sure that they do not get the treatment they deserve to make sure the injuries are taken care of and do not cause them pain for the rest of their lives.

The moments immediately following a car accident are usually the most difficult time for thinking clearly but they are very crucial to your case. It is normal for the victim to suffer from emotional shock, in addition to whatever bodily injuries he or she may have suffered. This can prevent you from focusing on vital issues such as having a strong case for claiming compensation for your injuries. What you do in the aftermath of a car accident can have a great effect on the result of your case, and the amount of compensation you will receive.

One of the most important things to do immediately after an auto accident is to contact a lawyer. This is because insurance companies will often agree to a better settlement if you are represented by a lawyer. However, you should not get the first lawyer you meet since not all have the experience that is necessary in representing clients aggressively in Dallas auto accidents.

There are several things that you should remember immediately after a car accident in order to get maximum compensation.

Get your injuries treated immediately

Your bodily injuries should be treated by a qualified doctor as soon as possible after the car crash. The treatment will give the insurance companies the necessary documentation for your injuries, which is necessary in a claim.

Photograph the accident scene and get your witnesses

If you have a camera with you, take pictures of the scene of accident as well as all the vehicles that are involved in the crash. If there are witnesses, get their names and contact details. The information you will get will be vital in building a strong case. It would be great if you can call The Goolsby Law Firm immediately so that we can take the necessary photographs for you.

Never talk about the accident with the insurance company

You should never discuss the car crash with anybody who has an association with the insurance company, even if it is your own. Insurance providers are business entities, and they will always attempt to deny or minimize your claim. Any statements you make to them can be twisted for their own good.

Do not put your signature on any document related to the accident

If you are offered a document that will release your claims, do not sign it. You should not make any recorded statement either.

Insurance firms are not your friends

After a car accident, insurance companies become your opponents. They are employing insurance adjusters, investigators and lawyers who are working together to minimize the value of your claim or deny it totally.

in Attorney Fees

We work on a contingency fee for personal injury cases, which means that you don’t pay us a dime unless we recover damages for you.

Contact a Dallas personal injury lawyer at The Goolsby Law Firm at 972-394-2141 or on as soon as you’ve been injured. The statute of limitations (the time during you which you can legally file a claim) in Texas for most personal injury cases is two years, but some types of cases have even shorter windows. Failure to initiate a claim during this time can disqualify you from ever collecting compensation for your injuries, so call us today.

What Damages Can I Recover?

in Damages & Settlements

The goal of recovery is to put you back in the same position (when possible) that you were in prior to the accident. An attorney can seek damages according to your individual situation and the extent of your injuries, including the cost of medical expenses (past and future), loss of wages, loss of consortium (loss of money, time or emotional connection due to an injury to a marital partner), pain and suffering, emotional distress, punitive damages (for cases involving gross negligence, usually by a company), compensation for disfigurement or paralysis and more.

in What Are Torts

Negligence torts are typically the result of inaction of a person or business to act in a reasonable manner in any given situation. Examples include not posting warning signs regarding wet floors or live voltage, or not taking the proper actions to prevent an auto accident (i.e. not stopping at a red light). The majority of personal injury cases are negligence torts.
